These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "your") and NorthRidge Systems LLC, a division of Four Nomadic Holdings, LLC ("Company," "we," "us," or "our"), governing your access to and use of the getfieldmetrx.com website (the "Site") and the FieldMetrx™ platform and related services (collectively, the "Services").
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.
The Services are intended for use by business owners and operators who are at least 18 years of age. By using the Services, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into these Terms, and are using the Services on behalf of a legitimate business entity.
FieldMetrx™ is a field operations intelligence platform designed for drain and trenchless contractors. The Services may include, but are not limited to: operational dashboards, AI-powered assistants, data analytics, scheduling integrations, and related tools. The specific features and functionality available to you will depend on your subscription plan and tier.
Access to the Services requires submission of an application through the Site. Submission of an application does not guarantee acceptance. We reserve the right to accept or reject any application at our sole discretion and for any reason.
If accepted, you agree to provide accurate, current, and complete information, and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
By optionally providing your phone number during the application process or at any point while using the Services, you expressly consent to receive SMS/text messages from NorthRidge Systems LLC related to:
Providing your phone number is optional. You are not required to provide a phone number to submit an application or use the Services. If you do provide a phone number, you consent to receive SMS messages as described above.
Message frequency varies based on your interactions and account activity.
Message and data rates may apply depending on your mobile carrier and plan. NorthRidge Systems LLC does not charge for SMS messages, but standard carrier rates apply.
Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message received from us. Upon opting out, you will receive a single confirmation message and will no longer receive SMS messages unless you re-opt-in. Opting out of SMS does not affect other forms of communication (e.g., email).

Supported Carriers: Our SMS service is compatible with all major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carriers are not liable for delayed or undelivered messages.
No Sharing of Opt-In Data: We do not sell, rent, lease, or share your phone number, SMS consent, or opt-in data with any third parties or affiliates for marketing or promotional purposes. Your opt-in information will only be shared with our SMS service provider for the sole purpose of delivering messages, or as required by law.
Certain features of the Services may require payment of fees. All fees, pricing tiers, and payment terms will be communicated to you prior to any charges. By subscribing to a paid plan, you agree to pay all applicable fees. Fees are non-refundable except as required by law.
The Services, including all content, features, functionality, software, text, graphics, logos, and trademarks (including FieldMetrx™ and Axel™), are owned by or licensed to NorthRidge Systems LLC and are protected by United States and international intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
We do not guarantee specific business results, revenue increases, or operational improvements from use of the Services. Any projections, examples, or estimates provided are for illustrative purposes only and are not guarantees of future performance.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NORTHRIDGE SYSTEMS LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless NorthRidge Systems LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws principles. Any disputes arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Fayette County, Pennsylvania, and you consent to the personal jurisdiction of such courts.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last Updated" date. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and NorthRidge Systems LLC regarding the use of the Services and supersede all prior agreements, understandings, and communications, whether written or oral.
